This agreement constitutes an order for services, items, and materials as specified under “Session”.
There are no oral or other agreements of the Parties hereto and this Agreement constitutes full and complete understanding and agreement between the client and Love Photography.
Love Photography agrees to provide photography services at the times and requested locations specified under “Date, Location, and Time”.
Payment is due at the time of the portrait session if applicable.
Vouchers are not redeemable for cash and any values stated are amounts equivalent to the value of services rendered. Refunds are not applicable for any vouchers received for free or through a promotion or business that received the voucher at no cost. All vouchers are valid at the discretion of Love Photography and Love Photography has the right to refuse the redemption of any voucher without notice.
Love Photography welcomes the Client to express their preferences with regard to the portrait photography. However, the Client agrees to let Love Photography choose the best photographic methods and abide by the decision made by Love Photography.
It is understood that Love Photography will not deliver every image that it makes. The Client agrees to abide by Love Photography’s editing decisions.
The image files and proofs will be ready for viewing within 20 business days after the portrait session. Love Photography keeps Client images on file for the duration of the life of the business entity known as Love Photography. Archiving the image files is Love Photography’s responsibility and reprints will be made available to the Client at the market rate at the time of the request.
The Client understands that their concerns about retouching or editing any of the photographs should be expressed to Love Photography within one week of the Client first viewing the images. After a week, Love Photography cannot guarantee that all retouching options will be available.
All images and copyrights are the property of Love Photography. Love Photography retains the right to copy, display, and/or publish any/all images created under this agreement, to the general public, for any reason, including but not limited to: advertising, marketing, sales, print competitions, educational seminars, and monetary gain. The mediums for display could include newspapers, magazines, books, television, and the internet, but are not limited to only those mediums.
Any use for general public or for monetary gain will be considered copyright infringement. The Client must obtain written permission from Love Photography and compensate Love Photography prior to the Client or their friends and family publishing or selling the photographs for profit.
This Agreement is not to be construed as an employment agreement in any way. Love Photography functions as an independent contractor.
Privacy Statement
Love Photography respects your privacy. This Privacy Statement explains in general terms how Love Photography protects the privacy of your personal information under the Privacy Act 1988 (as amended by the Privacy Amendment (Private Sector) Act 2000). It will apply to any personal information you provide to us when placing an order or requesting Information with us via any means and under any other agreement or arrangement. This Privacy Statement will also apply to any information about you that is provided to us by a third party.
What personally identifiable information is collected by Love Photography?
The types of personal information that we collect from you will depend on the circumstances of collection and on the type of service you request from us. These purposes could include registering to receive e-mail newsletters, requesting further information about our products or services, placing an order or simply asking a question. As we are required by law to obtain your consent to the collection of “sensitive information” we will assume that you have consented to the collection of all information that is provided to us for use in accordance with this Statement, unless you tell us otherwise. There may be occasions when we collect information about you from a third party, for example from people placing an order on your behalf.

Credit Card details are NOT stored on our database as all online financial transactions are completed on our third party merchant service.

We may disclose your personal information to third parties for the purpose for which the information was collected or for related purposes, for example to provide you with a service that you requested.

Returns, Refunds and Delivery Policy
Returns
Please note that each and every Love Photography product is inspected and quality controlled prior to delivery by a Love Photography team member. Love Photography does not operate a drop ship delivery model, or a delivery direct from the supplier model. Any Love Photography product that fails to meet the reasonable expectation of the client may be returned to Love Photography after consultation by phone explaining the issue. The Love Photography representative will arrange an amicable return process and advise of the time-frame that the product will be re-printed and re-delivered to the client. Love Photography does not accept any returns of digital images/files/negatives etc
Refunds
Love Photography does not offer any refunds under any circumstances due to the nature of the products being created specifically for each individual client. As there is a significant amount of negotiation and agreement between Love Photography and their clients on the commissioning of each photography product prior to the production of each piece, there is always plenty of time to makes changes and to cease the process.
Delivery Policy
Any physical products that are offered as part of the digital download packages of Love Photography will be shipped to clients free of charge. Any products ordered that are NOT part of the digital download packages will be individually quoted and charged as agreed.
